PURPOSE:
This document sets forth University policy and procedure regarding the basic issues surrounding residents engaging in professional and patient care activities that are external to their educational program, ie, moonlighting. This document covers:
- There is no "requirement" to engage in moonlighting
- licensure
- professional liability coverage
- internal moonlighting
- submitting a request to engage in moonlighting
- granting permission to engage in moonlighting
- monitoring the effects of moonlighting on the performance of residents in their educational programs, from both the institutional and program perspective
POLICY:

Institutional Requirement and Responsibility

Residents must not be required to engage in "moonlighting".

All residents engaged in moonlighting must be licensed for unsupervised medical practice in California or the state of practice.

It is the responsibility of the institution hiring the resident to moonlight to determine whether such licensure is in place, adequate liability coverage is provided, and whether the resident has the appropriate training and skills to carry out assigned duties.

UCSD liability coverage will not be extended to cover moonlighting activities of the resident that fall outside the course and scope of the individual's University appointment.

Moonlighting that occurs at UCSD, CHHC and the VAMC, ie, internal moonlighting, shall be counted toward the 80 hour weekly limit on duty hours.

The program director must provide a prospective, written statement of permission allowing the resident to moonlight. This statement shall be made a part of the resident's permanent file.

In the event a resident is given permission to moonlight, the program director shall monitor the resident's performance for the effect of these activities upon performance in the trainee's residency program. Adverse effects may lead to the withdrawal of permission to moonlight.

The GMEC will oversee the training programs' implementation and monitoring of the UCSD moonlighting policy.
The GMEC will monitor the training programs' compliance with UCSD moonlighting policy and procedure through periodic reviews/surveys conducted with the trainees and program directors and by requiring regular reports from each program. The GMEC will audit the data provided to assure that each program has demonstrated its' adherence to policy.
- The UCSD moonlighting policy must be disclosed to applicants to the GME training programs and to all current trainees.

Training Program Responsibility

Each program director must develop a written moonlighting policy and procedure document that implements the UCSD policy regarding professional activities external to the educational experience for the trainees in their program.

The program director must develop a mechanism for the trainees to communicate their request for permission to engage in external professional activities, for the duration of the time the trainee is participating in the ACGME accredited program.

The program director must provide a prospective, written statement of permission to the trainee allowing the individual to engage in moonlighting. This document will be made a part of the trainee's file.

In accordance with each program's moonlighting policy and procedure document, the program director shall monitor the effect of moonlighting activities upon the performance of the resident in his/her training program. Adverse effects may lead to the program director withdrawing permission to allow the resident to engage in professional activities outside the training program.

The program director shall also monitor "internal moonlighting" to assure that hours spent in that activity are counted toward the 80 hour weekly limit on duty hours.

Trainee Responsibility

Trainees will not engage in activity or employment that will interfere with their obligation to the University or to the effectiveness of the individual in the training program including the quality of patient care rendered.

Trainees will comply with the both their training program as well as UCSD policy and procedure regarding their professional and patient care activity outside of the UCSD training program.

Trainees will communicate their request to engage in moonlighting activities to their program director and will comply with the processes developed within their training program to implement the UCSD Moonlighting policy.
